Power 104.3 Million Dolla Holla Rules
NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1. WHO MAY PARTICIPATE. Subject to the additional restrictions below, Power 104.3 Million Dolla Holla (the "Contest") is open to legal residents of the State of Hawaii who are 12 years of age or older at the time of entry, are legal U.S. residents, and who possess a valid, government-issued photo identification. Employees of Power 104.3 ("KPHW FM" or "Sponsor"), Cox Radio, Inc., and American Hole n' One ("AHNO") and each of their respective parent, subsidiary, or affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win. The term "immediate family members" includes spouses, parents, grandparents, siblings, children, and grandchildren. Limit one (1) winner per household. For purposes of this Contest, a "household" includes all persons who are domiciled with an entrant, regardless of familial relation. Each winner and their household may only win ONE prize in excess of $100 on any Cox Radio Hawaii station (KCCN, KINE, KKNE, KRTR FM or AM and KPHW) during any 90 day period.

2. HOW TO BE A POWER 104.3 MILLION DOLLA HOLLA WINNER. Beginning October 7, 2005 and lasting through December 9, 2005 (the "Call-In Contest Period"),
1. Listen to Power 104.3 Monday through Friday between 6am and 8pm for the Million Dolla Holla- consisting of a selected soundbite.
2. The 104th call at 296-1043 will win $1,000 instantly and a chance to win $1million.
3. The 104th caller's birthday (month, day and year) matches the predetermined birthday, they will win the grand prize of $1 million. Any winning contestant must be the participant who originally dialed 296-1043 to participate in the contest. No family members, friends, office associates, or any other person will be allowed to participate in the contest on another person's behalf. Persons who have won another contest or promotion of any kind from KPHW within 120 calendar days before October 7, 2005 with values that exceed $100 or otherwise stated in previous contests on Any Cox Radio Stations are ineligible. When the selected soundbite is played, listeners must then call 808-296-1043. KPHW will select the 104th caller. If the 104th caller qualifies to participate, he or she will be declared the winner of $1,000 cash prize and an official finalist to win the grand prize. If the 104th caller is disqualified, the next verified caller will be declared the Cash Winner and official Finalist.
The official Finalist then must provide her own full name, home address, home phone number. Once the official Finalist has been selected and has identified herself, the contest supervisor will then record the Finalist's personal information on the official contest sign-in form. If the month, day and year of the official contestant's date of birth match the predetermined winning "date of birth" exactly, the official contestant will be declared the Grand Prize Winner and awarded the $1,000,000.00 40-year annuity(($1,000,000.00) maximum value)) Grand Prize.
There will be a maximum of one winner of the grand prize. This contest and the prize values may be ended or altered at the sole discretion of Power 104.3 following the award of the grand prize. If no official contestant matches the month, day and year of the predetermined winning date of birth, at the appropriate time, no grand prize will be awarded.

3. PRIZE CLAIM AND ACCEPTANCE PROCEDURES. Sponsor will notify each Cash Prize Winner by telephone when his or her prize is available to be claimed. Cash Prize Winners must claim their monetary prize in person by visiting KPHW studios at 900 Fort Street Honolulu, Hawaii 96813 upon notification that their prize is available to be claimed, and in no event later than thirty (30) days after the Winner's initial telephone call to the station (office visits must be Monday – Friday between the hours of 9:00 AM and 4:30 PM (HST). To claim prize, each Cash Prize Winner must present a valid government-issued photo identification. Prizes are non-assignable and nontransferable. No substitutions allowed by winners. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners will be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of personal delivery or date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner.
Any winning contestant must be the participant who originally dialed the phone to the radio station to participate in the contest. In the event of a Grand Prize winning contestant, the following requirements must be met:

• The contestant must provide sufficient identification, in person, by 5pm the business day following a Grand Prize winning contest.
• The name and social security number on the identification and original birth certificate must match exactly with the name and information provided during the contest, and the month, day and year of winners birthday must match exactly which the contestant was required to match.
  The grand-prize winner must present valid identification of valid driver's license, valid social security card, and original birth certificate by 5pm the following business day of award prize. The name, social security number on the identification and birthday must match exactly with the name and information provided during the contest. Grand-prize winner may be subject to polygraph test Winners of the Power 104.3 Million Dolla Holla must wait 1 year before participating in any contest on Power 104.3.
  In the event an eligible contestant has submitted a number code that matches the predetermined winning number code in exact order, the selected finalist will be awarded the grand prize subject to verification and approval by American Hole 'n One, Inc. The grand prize for this contest is: $1,000,000.00 40-Year Annuity.
  A maximum (1) grand prize will be awarded. In the event of more than (1) eligible grand prize winner(s) during this contest, the cash value of the grand prize(s) will be evenly distributed among all eligible winning finalist(s). Grand prize winner must accept delivery of prize from sponsor, or as otherwise instructed by sponsor. All other costs related to prize delivery and acceptance are the responsibility of winner including but not limited to taxes. All properly claimed prizes will be awarded. Prizes are non-transferable and no cash redemption or prize substitution allowed, except at sponsor's sole discretion or as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable. Grand prize winner(s) will be required to complete and return a W-9 form or appropriate tax form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release, and present a valid driver's license and social security card before prize will be awarded. Winners of prizes greater than $600.00 will be issued a 1099 form reflecting the value of the prize and are responsible for paying all income taxes on prize.
  Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, contestant will not receive any other prize substitution or compensation. Total ARV of all prizes: $1,000,000.00 40-Year Annuity.
  
  4. RESERVATION OF RIGHTS. Except where prohibited, participation in the Contest constitutes each entrant's consent to the use of his or her name, biographical information, voice and/or likeness in any media, including without limitation the Internet, for any commercial or promotional purpose, without limitation or further compensation. Any telephone calls placed to the POWER 104.3 contest line may be recorded for use on-air at any time. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor and AHNO. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor and the Contest administrators and judges. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest.
  
  5. DISCLAIMERS. By entering, participants acknowledge and agree that Sponsor, Cox Radio, Inc., AHNO, and their respective parents, subsidiaries, affiliates, officers, employees and agents (collectively, the "Contest Entities") will not be liable for losses or injuries of any kind resulting from acceptance/possession/use and/or misuse of prize(s), travel to and from any prize-related activity, participation in the Contest, printing, mailing or distribution errors, or any malfunctions of the telephone network, computer Internet system, computer equipment, software, or any combination thereof, or for any entries that are not in compliance with these Official Rules.
  
  6. CONSTRUCTION. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
  
  7. SPONSOR. Power 104.3 Million Dolla Holla is sponsored by POWER 104.3 (Cox Radio Hawaii), American Hole In One The decisions of Sponsor and the Contest administrators and judges regarding the selection of winners, the interpretation of these Official Rules and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
